How the Refund Cash Advance Program Works in 3 Steps

1

Free Cash Advance Assessment

Our team, coordinating with AmLaw 200 customs and trade attorneys, reviews your filed claim, assesses advance eligibility, and provides a confidential assessment. No cost. No obligation, and protected by attorney-client privilege.

2

Advance Structured and Approval

If your claim qualifies, our attorneys structure the advance with a third-party capital partner. This is a non-recourse sale of your refund receivable — not a loan. If CBP delays, reduces, or denies the refund, you have no repayment obligation.

3

Funds Are Sent to Your Account

Once structured, funds are transferred directly to your business' bank account. Our AmLaw 200 customs and trade attorneys continue managing your underlying claim with CBP from there. You have your working capital, we handle the rest.

Who Qualifies for Our Tariff Refund Cash Advance Program?

The advance is open to any US importer with a validly-filed IEEPA, or Section 301 refund claim, on any unconstitutionally-collected tariffs during 2025/6 — regardless of where or how it was filed:

Filed via CAPE Portal

Your CAPE Declaration has been submitted and accepted by CBP for Phase 1 unliquidated entries. You are waiting on CBP processing and disbursement — we can get your working capital back sooner than the year+ it could take.

Filed via Formal Protest

A CBP protest has been submitted for your entries, but protest processing typically takes 12–18 months, or longer — our cash advance program converts that wait into immediate, much-needed working capital for you.

Filed via CIT Litigation

Your claim is in active CIT litigation, which can take two or more years to resolve. An advance allows you to monetise the expected recovery — you get on with business as usual, while litigation continues behind the scenes.

Filed Through Another Law Firm

You already engaged a recovery service or law firm, and your claim is on file, but you haven't been paid yet. Ask your current firm if they offer a cash advance... Our advance is available regardless of who filed your claim.

Haven't filed yet? Your fastest path to working capital is to file first and claim a cash advance immediately after. Our AmLaw 200 customs and trade attorneys can handle both your filing and the cash advance as a single engagement — start with the free eligibility assessment on the homepage.

"What if CBP reduces or denies my refund?"
The advance is structured as a non-recourse sale of your refund receivable. If CBP reduces, delays, or denies the refund, you have no repayment obligation. The capital partner carries that risk, not you. The only exception is in cases of fraud.
"Does it matter who filed my original claim?"
No. The advance is available for any validly filed IEEPA or Section 301 tariff refund — whether filed through CAPE, a broker, a protest, CIT litigation, or another recovery firm. What matters is that a valid claim is on file and the refund is pending.
"Is this a loan? Does it affect my credit?"
This is not a loan. It is a non-recourse sale of a government-owed receivable to a third-party capital partner. It does not appear on your balance sheet as debt in the traditional sense, and it does not require a credit check or affect your credit standing.
"What does it cost?"
The eligibility assessment is free and carries no obligation. If you proceed with an advance, the cost structure is built into the advance itself — there are no separate upfront fees payable to TRGUSA or our attorneys. Full terms are provided during the assessment.
